Access to and use of the website, the platform, and the related services imply acceptance of these Terms and Conditions. Please read them carefully before using our services.
1. Scope of application
These Terms and Conditions govern access to and use of the Veralinx.art website, the Veralinx platform, and the related digital services, including, by way of example:
- registration of artworks;
- generation and management of Artwork Cards;
- use of NFC Tags;
- registration and association of information on digital infrastructures and/or blockchain;
- use of the Opera-ID web app for the identification of previously registered artworks.
Use of the website and services is permitted only in compliance with these Terms, applicable law, and the rights of third parties.
2. Nature of the services
Veralinx provides a technological platform designed to support the registration, management, traceability, and identification of artworks.
Veralinx does not carry out appraisal activities, expert authentication, legal certification of authenticity, artistic attribution, or commercial valuation of artworks. The platform provides digital tools that allow users to associate information, images, identifying data, and traceability systems with registered artworks.
Any statements relating to the author, provenance, authenticity, ownership, condition, or other characteristics of an artwork remain the sole responsibility of the person who enters or manages such information.
3. Artwork registration and user responsibility
The user who registers an artwork or uploads content to the platform declares and warrants that they:
- have the right to upload, use, and communicate the relevant content;
- provide truthful, accurate, and up-to-date information;
- do not infringe the rights of third parties, including copyright, trademarks, image rights, moral rights, or other intellectual or industrial property rights;
- use the platform lawfully and in accordance with its intended purpose.
The user is solely responsible for the content uploaded, the statements made, and the correct association between the artwork, the Artwork Card, any NFC Tag, and the registered information.
4. Opera-ID
Opera-ID is a web app intended for the identification of artworks already registered on the platform through comparison with reference data and images.
Depending on the case, Opera-ID may operate on the basis of images acquired through the device camera and technical data associated with the operation, including geolocation, where available, authorized, and necessary.
The identification or matching result provided by Opera-ID:
- is technical and informational in nature;
- depends on the quality of the images, shooting conditions, the device used, and the data available in the archive;
- does not constitute definitive legal proof of authenticity, provenance, or ownership of the artwork.
5. No guarantee of authenticity
Veralinx does not guarantee that artworks registered on the platform are authentic, original, lawful, correctly attributed, or free from disputes.
Veralinx does not verify, by means of expert, historical, artistic, scientific, or legal assessment, the truthfulness of the information uploaded by users. The platform provides technological tools solely to support registration, identification, and traceability.
6. Permitted use and prohibitions
The user agrees not to:
- use the website or services for unlawful, fraudulent, or misleading purposes;
- upload false, manipulated, defamatory, offensive, discriminatory, or unlawful content;
- infringe the intellectual property rights of third parties;
- attempt to compromise the security, integrity, or operation of the platform;
- bypass authentication systems, access controls, or protection measures;
- use NFC Tags, Artwork Cards, or other Veralinx tools improperly or without authorization;
- use automated or semi-automated tools, including crawlers, scrapers, bots, data extraction software, harvesting systems, or similar technologies, to access, collect, extract, copy, acquire, index, monitor, or reuse, in whole or in part, content, images, data, metadata, Artwork Cards, or other information available on the platform, unless prior written authorization has been granted by Veralinx or by the holder of the relevant rights;
- use the content available on Veralinx.art, including images, texts, data associated with artworks, Artwork Cards, and related informational elements, for text and data mining purposes, training of artificial intelligence models, dataset creation, automated analysis, or other processing activities not expressly authorized in writing.
Veralinx reserves the right to limit, suspend, or terminate access to the services in the event of improper, unlawful, or non-compliant use of these Terms.
7. User account
Access to certain features may require the creation of an account.
The user agrees to:
- provide accurate and up-to-date information;
- keep login credentials secure;
- not share their account with unauthorized third parties;
- promptly inform Veralinx in the event of unauthorized access or suspected compromise of the account.
The user remains responsible for activities carried out through their account, unless they prove that the misuse was not attributable to them.
8. NFC Tags, Artwork Cards, and traceability
Where provided as part of the service, Veralinx may associate registered artworks with tools such as Artwork Cards, NFC Tags, or other digital identifiers.
The user is responsible for the correct application, preservation, and use of such tools. Veralinx shall not be liable for issues arising from:
- incorrect installation;
- removal, tampering, or improper use of the Tag;
- physical deterioration of the artwork or supporting materials;
- unauthorized use by third parties.
The traceability, identification, and registration systems available on the platform are intended to improve the documentation and reconstruction of the information associated with the artwork, but do not constitute an absolute guarantee against fraud, disputes, or improper use.
9. Intellectual property
Unless otherwise indicated, the Veralinx.art website, the Veralinx trademark, logos, design, texts, interfaces, platform structure, software, databases, and other content made available by Veralinx are protected under applicable intellectual and industrial property laws.
The user retains the rights to any content they own, but grants Veralinx a non-exclusive license, to the extent necessary for the provision of the services, to use, store, process, display, and associate such content within the platform.
Images, data, metadata, descriptions, and other content associated with registered artworks remain subject to the rights of their respective owners. Their presence, display, or consultation on the platform does not imply any license grant, transfer of rights, or authorization to reproduce, extract, reuse, process, or exploit them for purposes beyond the ordinary use of the services.
Veralinx further reserves the right to prohibit or limit automated extraction, systematic collection, and unauthorized use of the content available on the platform, including uses aimed at the creation of archives, datasets, analytical models, or artificial intelligence systems.
It is prohibited to copy, reproduce, distribute, modify, extract, reuse, or exploit the content and elements of the platform without the prior written authorization of the rights holder.
10. Orders, payments, and refunds
Where Veralinx offers paid products or services, the user agrees to provide correct and complete payment details.
Veralinx reserves the right to refuse or cancel orders in the event of:
- unavailability of the product or service;
- material error in the price or description;
- payment issues;
- reasonable suspicion of fraud or abuse.
Artwork Cards that have already been registered or customized for a specific artwork, and NFC Tags that have already been programmed, associated with an artwork, or shipped to the customer, constitute customized products and/or services.
For this reason, except in cases of defects, lack of conformity, or other mandatory rights provided by applicable law, such products and services are non-refundable and may not be cancelled or withdrawn once customization, registration, or shipment has been completed.
Any claims relating to defective or non-conforming products must be communicated within a reasonable time from receipt, together with adequate supporting documentation.
In any case, Veralinx reserves the right to assess justified requests on a case-by-case basis.
11. Suspension, termination, and account closure
Veralinx may suspend, limit, or close a user account in the event of:
- violation of these Terms;
- unlawful, fraudulent, or unauthorized use of the services;
- conduct that may endanger the security of the platform or the rights of third parties.
The user may request closure of their account at any time by contacting Veralinx customer support.
Closure of the account does not automatically result in the deletion of all data, files, records, or content already associated with the services used, to the extent their retention is necessary for legal obligations, technical requirements, security reasons, protection of Veralinx’s rights, or due to the nature of the systems used.
In particular, data relating to artworks already registered, files generated within the scope of Veralinx services, technical logs, and any records made on blockchain infrastructures may remain stored, in whole or in part, even after account closure, where such elements cannot technically be modified or deleted, or must be retained for legitimate operational, documentary, evidentiary, or legal purposes.
12. Limitation of liability
To the maximum extent permitted by applicable law, Veralinx provides the website and services “as is” and “as available,” without any guarantee of uninterrupted operation, absence of errors, or full compatibility with all devices and configurations.
Veralinx shall not be liable for:
- inaccuracies, omissions, or falsehoods in content uploaded by users;
- disputes concerning the authenticity, provenance, ownership, or economic value of artworks;
- incorrect or incomplete outcomes resulting from low-quality images, unfavorable environmental conditions, device errors, or insufficient data;
- interruptions, malfunctions, cyberattacks, force majeure events, or the unavailability of third-party services;
- indirect damages, loss of profits, loss of opportunity, reputational harm, or business interruption, except in cases of willful misconduct or gross negligence and without prejudice to mandatory provisions of law.
Any limitation of liability not permitted by applicable law shall in all cases remain excluded.
13. Third-party content and external links
The website may contain links to third-party websites, content, or services. Veralinx does not control such resources and is not responsible for their content, operation, availability, or the data processing carried out by third parties.
14. Changes to the Terms and Conditions
Veralinx may update or amend these Terms for legal, technical, organizational, or service development reasons.
Changes will be published on this page together with the updated date and shall become effective from the date of publication, unless a different effective date is expressly stated.
Where the changes significantly affect users’ rights or obligations, Veralinx will take reasonable steps to bring them to the attention of the users concerned.
15. Governing law and jurisdiction
These Terms and Conditions shall be governed by Italian law.
Any dispute relating to the interpretation, validity, or performance of these Terms shall be subject to the jurisdiction of the Italian courts, without prejudice to any mandatory consumer protection forum provided by applicable law.
