1. Scope of Services
Veralinx.art provides a digital platform for the registration and authentication of artworks through Artwork Cards, NFC TAG application, and blockchain technology. We also offer Opera-ID, a web app for identifying previously registered artworks, which uses the device’s camera and geolocation to perform a matching process with the original artwork.
2. Authentication Responsibility
The authentication process for artworks registered on Veralinx is the sole responsibility of the author, meaning the content editor—the artist or an authorized representative.
Veralinx solely provides the technology to support the authentication process and does not perform evaluations, expert assessments, or certifications of authenticity. Therefore, Veralinx is not responsible for errors, omissions, or inaccuracies regarding the authenticity of the artworks registered by users.
3. Limitation of Liability
Veralinx.art does not guarantee that artworks registered on the platform are authentic.
Our role is limited to providing digital tools for managing and marking authenticity. We do not conduct appraisals, expert assessments, or verifications of the uploaded artworks’ validity.
Opera-ID uses the device’s camera and geolocation to generate a matching index with the original artwork. However, the accuracy of this process depends on the quality of the images and the device’s configuration.
As a result, Veralinx shall not be held liable for any disputes, claims, or damages arising from the authenticity or misuse of data related to registered artworks.
4. Use of the Website and Services
Users of Veralinx.art and Opera-ID must use the website and services in accordance with these Terms and Conditions and must not violate third-party intellectual property rights. Any unauthorized use of the site and services may result in the immediate suspension or termination of access, with the possibility of further legal action.
User Obligations:
Registration and accurate data: Users must provide truthful information when creating an account and uploading artworks.
Artwork management: Artworks registered on the platform must be accurately and truthfully represented.
TAG security: Users must ensure the correct application of NFC TAGs and prevent unauthorized use.
5. Intellectual Property
Users grant Veralinx the right to use uploaded content for the provision of services.
All content, logos, images, designs, and materials on Veralinx.art and Opera-ID are protected by intellectual property rights and belong to Veralinx or their respective owners.
It is strictly forbidden to reproduce, distribute, or use any content without prior written consent.
6. Payments and Refunds
Users can make payments online or via invoice for products and services.
Refund Policy:
Products are custom-made and are generally non-refundable, except in cases of defects or non-compliance with declared specifications.
Refund requests for defective products must be made within 7 days of receipt.
Veralinx reserves the right to reject orders in case of product unavailability, payment issues, or pricing errors.
7. Account Suspension and Termination
Veralinx may suspend or terminate a user account in cases of terms violations, fraudulent use, or unauthorized access.
Even after suspension, uploaded artwork data may remain visible to other registered users, if enabled.
Users may request account deletion, but Artwork Cards registered on the blockchain cannot be removed.
8. Content Rules
Users must not upload false, misleading, or illegal content.
Copyright, trademark, or third-party rights violations are strictly prohibited.
Offensive, discriminatory, or hate-inciting content is not allowed.
Veralinx reserves the right to remove any content that violates these rules, even without prior notice.
9. Certificates and Artwork Transfers
Veralinx is not a sales intermediary.
When an artwork is sold or transferred, the new owner (if registered on the platform) can identify it using the Opera-ID web app and/or by reading the NFC TAG. These operations are recorded in the Veralinx server log, ensuring traceability of the artwork.
This system assists in provenance verification but is not an absolute guarantee.
10. Liability Limitations
Veralinx provides the service “as is”, with no guarantees regarding continuous availability or the absence of errors.
Veralinx is not responsible for damage to artworks resulting from the use of its products.
In case of issues related to an artwork, Veralinx’s liability is limited to the replacement cost of the provided products.
Veralinx is not responsible for economic losses, data damage, or business interruptions arising from the use of the service.
11. Changes to Terms and Conditions
Veralinx reserves the right to modify these Terms and Conditions at any time.
Any changes will be published on this page and will become effective on the date of publication.
Users will be notified at least 7 days in advance if modifications negatively impact their rights.
Minor updates (e.g., technical improvements) will take immediate effect.
We recommend regularly checking this section to stay informed of any updates.
12. Governing Law
These Terms and Conditions are governed by Italian law.
In case of disputes related to these terms or the use of Veralinx.art and Opera-ID, the parties agree to submit to the exclusive jurisdiction of Italian courts.
